The following booking conditions form the basis of your contract with Ross OC Jennings (Breacans) - "we", "us" and "our". Please read them carefully as they set out our respective rights and obligations. By confirming your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.

 

1. Deposit Requirement

 

​A deposit of $275 USD per person, or equivalent in other currencies, is required to secure your spot on any Breacans Trip. This is refundable for 7 day after deposit payment is made, minus any associated transaction fees. If we do not receive this deposit, we cannot guarantee you a space on the Trip. Once this deposit has been received, we will send confirmation via email.

2. Payment Requirements

​

Any outstanding trip-related cost must be paid no later than:

​

• Midnight Friday 19th April 2024, for the July Scotland Trip

• Midnight Friday 21st July 2024, for the September Scotland Trip

• Midnight Friday 4th October 2024, for the December Guatemala Trip

 

Failing to provide full payment by this date may result in cancellation of your trip and loss of prior payments made. The cost of extra services booked later than these dates must be paid immediately upon booking.

3. Cancellation by the Traveller

​

In order to cancel your participation on the Trip, you must provide Ross OC Jennings (Breacans) with a written notification of your cancellation by email to contact@breacans.com. The date of your cancellation is the date on which Breacans receives such notification. If you cancel your participation in the Trip, the cancellation fees listed below will apply.

July Scotland Trip:

​

• After 7 days of paying your deposit the $275 USD is non-refundable.

• If you cancel your participation on the Trip after 19th April 2024 but before midnight 14th June 2024, a fee of 50% of the Trip cost will apply (minus any associated transaction fees).

• If you cancel your participation on the Trip after 14th June 2024, a fee of 100% of the Trip cost will apply (minus any associated transaction fees).

• If you leave the Trip for any reason after it has commenced, or miss any features thereon, no refunds for unused services will be made.

September Scotland Trip:

​

• After 7 days of paying your deposit the $275 USD is non-refundable.

• If you cancel your participation on the Trip after 21st July 2024 but before midnight 16th August 2024, a fee of 50% of the Trip cost will apply (minus any associated transaction fees).

• If you cancel your participation on the Trip after 16th August 2024, a fee of 100% of the Trip cost will apply (minus any associated transaction fees).

• If you leave the Trip for any reason after it has commenced, or miss any features thereon, no refunds for unused services will be made.

December Guatemala Trip:

​

• After 7 days of paying your deposit the $275 USD is non-refundable.

• If you cancel your participation on the Trip after 4th October 2024 but before midnight 29th November 2024, a fee of 50% of the Trip cost will apply (minus any associated transaction fees).

• If you cancel your participation on the Trip after 29th November 2024, a fee of 100% of the Trip cost will apply (minus any associated transaction fees).

• If you leave the Trip for any reason after it has commenced, or miss any features thereon, no refunds for unused services will be made.

4. Things to Consider

 

Breacans Trips are one of a kind Trips that have been specifically created by Travis & Ross. Our aim is to be inclusive of all genders, sexual orientations, races, and ethnicities. Before signing up, please be aware that you will be with a group of people from different backgrounds, identities, and political views. 

 

Guests cannot join halfway through the trip or join for certain portions. Although you are more than welcome to leave the trip at any time, the trip must be paid for in its entirety, and you will not receive a refund for incomplete portions of the trip. If you do opt to leave at any time during the trip, we endeavour to assist with your needs as best we can, but the costs incurred by doing so will not be covered by the trip fee or by Ross OC Jennings (Breacans). If you are part of the LGBTQ+ community, you will be safe; members of the staff are both part of the community and are allies. There is a zero tolerance of drugs. If you bring or acquire any drugs (that are not prescribed by your doctor) while on this trip, you will be removed immediately and will not be refunded for any portion of the trip you will have missed. We understand people will want to have some drinks at night, but please bear in mind that we will have some early mornings. It will be your own responsibility to be ready to hit the road in the morning. We will be unable to accommodate people that want to sleep in.

5. Your Details

 

In order for us to confirm your travel arrangements, you must provide your full name as per your passport, date of birth, and any pre-existing medical or other conditions you have which may affect your ability to complete your travel arrangements. We required you to fill out a personal details form reserving your spot. This will allow us to better assist you during the Trip. Additional information, such as passport number, etc., may be required on a trip-by-trip basis. 

 

6. Itinerary Disclaimer

While it is our intention to adhere to the route described in the itinerary, we reserve the right to change the trip itinerary, accommodations, activities, transportation, or any other element of a trip either before the trip departs or during the trip itself. You acknowledge that travel requires considerable flexibility. The itinerary provided for each trip is representative of the types of activities planned, but the route, schedules, activities, accommodations, site visits, amenities, mode of transport, and any other trip elements may be altered or changed without prior notice due to health, safety, security, quality, group size, local circumstances or events, or any other concerns as deemed necessary by Ross OC Jennings (Breacans).

 

7. Inclusions

 

The price of your trip includes:

• Accommodation (shared, unless private room is booked) throughout the trip.

• All meals as described in the itinerary.

• One alcoholic (or non-alcoholic) drink for the welcome dinner.

• All experiences as described in the itinerary.

• Transportation throughout the trip.

• Dedicated guide & host (Ross). 

 

8. Exclusions

​

The price of your trip does not include:

• Transportation and flights to/from destination (Guatemala or Scotland).

• Pre/post trip accommodation.

• Travel insurance.

• Additional meals and drinks outside of itinerary.

• Passport and visa fees (if applicable).

• Customary gratuities for Guides & Drivers.

9. Accommodations

 

We will not be staying in 5* hotels throughout the trip, but equally, we have made sure that we are staying in unique, reputable and comfortable accommodation. Accommodation will vary in quality depending on where we are. 

 

Single travellers joining the trip will be paired up with another traveler (of the same gender) in a twin room. Travellers that wish to have their own private room, throughout the trip, must pay a single supplement, as listed in the trip additional information section of the trip page.

 

10. Age & Health Requirements

 

General Policy: All travellers must be at least 18 years old by the date of travel. We have no upper age limit, although passengers must ensure that they are suitably fit to allow full participation. Please be prepared for very full and active days.

11. Passports & Visas

 

All countries require a valid passport (with a minimum of 6 months validity). Contact your local embassy, or consulate for the most up-to-date visa requirements. It is your responsibility to have the correct travel documentation.

 

12. General Waiver

​

You acknowledge that during our trip you participate voluntarily in any and all activities arranged by the trip organiser Ross OC Jennings (Breacans), and insofar as legally permissible, surrender your right to any cause of action against Ross OC Jennings (Breacans) arising from any loss or damage to person or property that occurs during the trip.

 

13. Acceptance of Risk

 

You acknowledge that the nature of the Trip is adventurous and participation involves a degree of personal risk. It is your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of the United States Department of State and the Centres for Disease Control provide valuable, country-specific information regarding health and safety information. 14. Medical and Health Issues

​

Health declaration:

​

I (traveller) take full responsibility for my medical, psychological, and physical condition for the duration of your travels with Ross OC Jennings (Breacans). I am unaware of any medical, psychological, or physical problems that would, in any way, impair my ability to complete the trip safely or to engage in all of the activities of it, nor am I aware of any health-related condition or limitation that might impact the safety, security, or comfort of my traveling companions. Should I receive any new information regarding my health before my trip departs, I will notify Ross OC Jennings (Breacans). I will immediately notify the trip leader and take full responsibility for promptly accessing necessary and appropriate medical care. I take full responsibility for possessing adequate medical health insurance coverage to pay for the medical care I may require during my trip with Ross OC Jennings (Breacans).

 

15. Travel Insurance

 

Your trip cost does not cover individual travel insurance. You are free to purchase travel insurance from anyone you wish but we recommend purchasing coverage through the travel insurance provider Yonder Travel Insurance. You can visit Yonder’s website for more details. Policies vary, but personal travel insurance generally covers trip cancellation, trip interruption, and stolen or damaged personal items.

16. Compliance with Law

​

You must at all times comply with the laws and customs of the places visited on the trip. Ross OC Jennings (Breacans) will not be liable for transgressions or violations, intentional or unintentional, of local laws or customs and the consequences that result therein. Participants are subject to all local laws, ordinances and regulations. Violations can lead to fines, imprisonment and/or deportation, among other penalties and consequences.

17. Release of Liability

​

Ross OC Jennings (Breacans) does not own, manage or operate any person or entity which is to or does provide goods or services for during the trip, including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, entertainment venues, ground operators. Ross OC Jennings (Breacans) is not responsible for any negligent or willful act or failure to act of any such person or entity, nor for any act or inaction of any other third party not under his (its) control. In addition, I release Ross OC Jennings (Breacans) from his (its) own negligence and assume all risk thereof.

Without limitation Ross OC Jennings (Breacans) is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, inconvenience, or irregularity of any kind which may be occasioned by reason of any act or omission beyond its control, including, without limitation, any willful or negligent act, failure to act, or breach of contract of any third party, such as an airline, train, vessel, hotel, restaurant or food supplier, bus, taxi, van, local outfitter or guide. Ross OC Jennings (Breacans) is not responsible for any loss, injury, death, or inconvenience due to acts of God, force majeure, or acts of government, delay or changes in schedule, overbooking or downgrading of accommodations or any defects therein, insolvency or bankruptcy of a supplier or others, default of any third party, epidemics or the threat thereof, terrorism or the threat thereof, bites or attacks by animals, insects or pests, sickness, the lack of appropriate medical care, evacuation to same, if necessary or meaningful delays in obtaining any medical assistance. In addition, medical assistance when rendered may not be comparable with that obtainable in the participant’s home. Participant assumes all such risks as well as those associated with high elevation diseases, extreme or unusual physical exertion for which participant is not prepared, risks associated with food or unpure water, weather, strikes conditions on and perils of the seas such as storms or currents, availability of any transportation mechanism or its arrival or departure timely or safely; war; quarantine; criminal activity; or any other cause beyond Ross OC Jennings (Breacans) direct control. 

 

Ross OC Jennings (Breacans) reserves the right to change or reprice any trip, extension or expedition due to acts of insurrection, strikes, acts of God, or any other cause beyond its control. Ross OC Jennings (Breacans) may, as it deems advisable, among other things, postpone or cancel a trip, alter or omit any part of the itinerary; substitute hotels, leaders or trip features; or change any means of conveyance without notice and without refund, with the liability for increased costs, if any, to be borne by travelers. If Ross OC Jennings (Breacans) cancels any trip, extension, or expeditions, or portions thereof, due to acts of insurrection, strikes, acts of God or government, epidemics, acts of terrorism, third party default or insolvency or any other cause beyond its control, its sole obligation is to issue credits in the full amount of moneys paid to Ross OC Jennings (Breacans) but only to the extent its suppliers are crediting Ross OC Jennings (Breacans) with those moneys paid by Ross OC Jennings (Breacans) to them. Under no circumstances is Ross OC Jennings (Breacans) obligated to refund the cost of any purchased travel insurance. 

While traveling to Guatemala, disruptions and situations may occur, including, but not limited to, delay, partial or complete changes in timing or routing of itinerary, changes in trip leaders, changes in grades of or location of lodging and modes or quality of air, land, and/or sea transport. Ross OC Jennings (Breacans) may make last-minute decisions to address changed circumstances. Ross OC Jennings (Breacans) does not guarantee conformity with the itinerary or itineraries that have been posted or furnished to me. Ross OC Jennings (Breacans) reserves the right to accept or reject any person as a trip member at any time. All trip bookings are subject to acceptance by Ross OC Jennings (Breacans).

18. Non-Tour Activities

 

Non-tour activities do not form part of the trip. Any assistance given by your group leader or local representative in arranging such activities does not render Ross OC Jennings (Breacans) liable for them in any way. The contract for the provision for that activity will be between you and the activity provider.

19. Photo and Video Release Form

​

I hereby grant to Ross OC Jennings (Breacans) the absolute and irrevocable right and unrestricted permission to use photographic portraits/images/videos in which I feature that are taken during the course of the trip to use / re-publish / copyright, etc. for commercial use in association with the Ross OC Jennings (Breacans) business. I hereby release and discharge Ross OC Jennings (Breacans) from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

 

20. Baggage & Personal Items

​

Baggage and personal property are at owner’s risk at all times, including when they are in hotel rooms, in transit or when entrusted to Ross OC Jennings (Breacans) or independent contractors. We recommend against bringing expensive jewelry, electronics, or other valuables on the trip. Ross OC Jennings (Breacans) will not be held responsible for any theft, loss, damage, destruction or other issue with personal belongings resulting from participation on a Breacans trip, regardless of the cause of such.  All purchases are at your own risk including risks related to shipping, storage, quality and conformity with descriptions.
